Spencer Elden, who was the baby swimming on the cover of Nirvana's Nevermind, is now suing Dave Grohl, Krist Novoselic and the Kurt Cobain estate. TMZ reports that Elden claims he could not consent to his image being used on the album art way because he was only four months old and his legal guardians didn’t consent to it either. Elden claims the cover image is child pornography and that the band didn't meet a promise to cover his genitals with a sticker.
Elden is seeking at least $150,000 in damages.However, the Elden hasn't had a problem in celebrating the album cover before. He recreated the shot for the album's 15th and 25th anniversary. And in a 2008 interview he claimed the shoot only took 15 minutes and that his parents -- not legal guardians -- were paid $200 for it.
